Terms of Use
The terms on which you may use the Uchaguzi website and apps, including the acceptable use rules.
Version 1.0 · 22 October 2026
These terms (together with the documents they refer to) tell you the terms on which you may use Uchaguzi: this website, the web app and the mobile app. Please read them carefully before you start. By using Uchaguzi you accept these terms and agree to follow them. If you do not agree, please do not use the platform. How we handle personal data is explained in our Data Privacy Statement, which forms part of these terms.
Information about us
Uchaguzi is operated by Stelden EA Ltd (“Stelden”, “we”, “us”), a company registered in Kenya, of Nairobi, Kenya.
Accessing the platform
You must be 18 or older to hold an account. You sign in with your mobile number and a code we send to it; staff roles also use a second sign-in step. Keep your codes, devices and passwords to yourself, and tell us at once if you think someone else has used your account. You are responsible for what is done through your account.
We may change, suspend or withdraw any part of the platform without notice for maintenance, security or legal reasons, and we are not liable if it is unavailable for a period. We may disable an account or a sign-in code if we reasonably believe these terms have been broken. You are responsible for your own internet and phone access.
Campaign accounts and subscriptions
A campaign account has one owner, who may add billing administrators and invite team members into the roles the plan allows. Plans, prices and what each includes are shown on our pricing page and when you buy; prices are in Kenya shillings and include VAT. Each account may have one free trial.
Subscriptions are billed in advance, monthly or for the term you choose, from the campaign's wallet. If a payment is late, the campaign keeps full access for a grace period, then read-only access, and is then paused until it pays; the periods are shown in the app. A campaign is not paused in the protected period around polling day. When a subscription ends, the owner can export the campaign's data for 30 days, after which it is deleted. Some features that act in the candidate's name, such as public pages, own sender names and bulk messages, are available only after we have verified the campaign.
Your campaign's data
Your campaign owns the data and content it puts on the platform. You give us the right to host, copy and process it only to provide the platform to you, as our Data Privacy Statement describes; for that data your campaign is the data controller and we are its data processor. You are responsible for collecting data lawfully and for the messages your campaign sends.
Acceptable use
You may use the platform only for lawful purposes and in line with Kenya's election, data protection and cybercrime laws, including the Elections Act, 2011, the Election Offences Act, 2016, the Election Campaign Financing Act, 2013, the National Cohesion and Integration Act, 2008, the Data Protection Act, 2019 and the Computer Misuse and Cybercrimes Act, 2018. You must not use the platform:
- to spread hate speech, incite violence or promote contempt for any community;
- to offer or give money, gifts or other benefits for votes, or to threaten or intimidate voters, agents or officials;
- to spread false information about the election process, polling places or results, or to pretend to be the IEBC, another candidate, a party or an official;
- to send messages to people without a lawful basis, to ignore opt-outs, or to use voter data or registers that were not obtained lawfully;
- to record or demand proof of how anyone voted;
- to harass, track or watch people, or to publish other people's personal data;
- to announce results as official before the IEBC declares them;
- to feature children in campaign material without a parent's or guardian's consent;
- to send spam or unsolicited advertising;
- to share accounts or resell access without our written agreement;
- to copy, scrape or reverse engineer the platform, or overload or disrupt it.
Viruses, hacking and other offences. You must not introduce viruses, trojans, worms or other harmful material, try to gain unauthorised access to the platform, its servers or any connected system, or attack it by denial of service. Doing so may be an offence under the Computer Misuse and Cybercrimes Act, 2018. We will report such breaches to the relevant authorities and cooperate with them, and your right to use the platform will end immediately.
If we reasonably believe these rules have been broken, we may remove content, stop messages, suspend or close accounts and, where the law requires, report the matter to the relevant authorities.
Intellectual property rights
We own or are licensed to use the platform and everything in it that is not your campaign's content, including its software, design and text. You may use the platform for your campaign while your account is active. You may print or download pages of this website for your own reference, but you must not alter them or use them commercially without our permission, and our status as authors must be acknowledged. The Uchaguzi name and logo may not be used without our written permission.
Reliance on information posted
Information on the platform, including guides, spending limits and election timetables, is provided for convenience and is not legal or financial advice. Check important matters with the official source, such as the IEBC or the gazette, before relying on them.
Our site changes regularly
We update the platform often and may change its content and features at any time. Some content may be out of date at a given moment, and we are under no obligation to update it.
Our liability
The platform is provided as it is, without warranties beyond those the law requires. To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of income, data, opportunity or goodwill. Our total liability to a campaign in connection with the platform is limited to the fees it paid us in the three months before the claim. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or any other liability that cannot be limited by law, and nothing affects your rights under the Consumer Protection Act, 2012.
Information about you and your visits
We process information about you in line with our Data Privacy Statement. You confirm that the information you give us is accurate.
Uploading material to the platform
Anything you upload or send through the platform must follow the acceptable use rules above, and you are responsible for it. We may remove material that breaks them. If someone claims that material you posted infringes their rights or breaks the law, we may disclose your identity to them or to an authority where the law allows or requires.
Ending your use
An owner can cancel a campaign's subscription in the app at any time; it ends at the end of the paid period. We may suspend or end access if these terms are broken, if fees are not paid, if the law requires it, or to protect the platform or other users. We will give notice where we reasonably can.
Linking to our site
You may link to our home page, provided you do so in a way that is fair and legal and does not suggest any association with, approval of or endorsement by us where none exists. You must not frame our site on any other site. We may withdraw linking permission without notice. If you wish to use our content in any other way, contact us at privacy@uchaguzi360.co.ke.
Links from our site
Where our site links to other sites and resources, the links are for your information only. We have no control over them and accept no responsibility for them or for any loss that may arise from your use of them.
Jurisdiction and applicable law
These terms are governed by the laws of Kenya. If a dispute arises, we will first try to settle it with you in good faith within 30 days. If that fails, the courts of Kenya have exclusive jurisdiction, although we may bring proceedings for a breach of these terms in another country where the breach occurred.
Variations
We may revise these terms at any time by updating this page; the version and date at the top show when they last changed. We will tell account holders about material changes in advance by email or in the app. Please check this page from time to time, as the terms in force when you use the platform bind you. Some provisions may be superseded by notices published elsewhere on the platform.
